Registerer keeper or owner

My employer has made me the registered keeper of a company car without my prior knowledge.

The DVLA have sent the registration certificate to me and it looks all the world like the car is now registered mine as the form has V5C on the front?

is it even possible to to have the owner and keeper as different people?

AFAIK, the registered keeper (name on the V5) may not necessarily be the legal owner (a loan company for example).

Many years ago I saw some thing on the Telly about some wide boy who sold his company car as htey had him as the Registered Keeper. The poor unsuspecting person that bought it was horrified to find the car was not in fact his.

It does in some ways have benefits for you to be the Registered Keeper.   The Leasing company don't get the hassle of sorting out Parking and other Fixed Penalty Notices.

So if you buy a car ask to see the Receipt for the purchase.

Registering the car in your name may also lower your tax on benefits check it out.

To quote a recently arrived V5C.
Section 1 Registered Keeper
The registered keeper remains liable for the Vehicle until dvla is notified of its sale/transfer/scrapped/export and is responsible for ensuring the vehicle is properly registered and licensed.

Section 5 Registered Keeper
C.4.c - The registered keeper is not necessarily the legal owner.

Thats handy, I tax it they own it!

Its happened as some of our engineers think there vans are invisable to the congestion charge, the company gets the ticket and the engineers squabble about who was driving etc.

Now its up to whoever is the keeper to make sure all fines are paid prompt. I guess it makes sense, but I am a bit concerned that I am liable for taxing it which in turn means I have to claim expenses, something that is not always given the urgency it should.

I dont see it making a difference to my tax, I dont own it and it and its not a gift.


Its well worth noting that if your buying a 2nd hand car that the V5 is not proof of ownership, I can see it tempting some people to flog a car and run.

Had some fun with DVLA lately regarding ownership...

Heres a brief overveiw of what happened.

5 months ago I moved house, also sold my rally car the same week. Popped 3 log books in the same envelope- two for change of address and the third for a change of keeper. OK, got that?

2 weeks later the two log books from the cars we were keeping arrived with details changed, no problems.

Fast forward to today. I now have a court summons for non payment of fines- £150 plus costs. ??

Turns out that DVLA claimed I did not notify them of a change of keeper on the Rally car. They say they DID NOT receive the completed log book (funny how they got the other two isn't it?). They also sent the original fine (£55) to my old address (so I did not get it), then sent me to court (summons to old address too).

I had it out with a guy at DVLA last week. It turns out that I should have rung them after 28 days to see if the change of keeper had been made! WTF? I clearly didn't take due care that this was done, therefore I got the fine.

Now lets apply common sense here. You get the back the two log books you were expecting back quite promptly and new owner hadn't called to say he didn't yet have his log book- would you presume that all was well? They were all in the same envelope after all!

 Not good enough. They send out a letter to tell you that the records have been updated now, and there is also a call centre to call if you don't get the letter that you didn't know you were going to get in the first place. Nice trap to generate a little more money for the coffers isn't it?

 In the last 2 years DVLA have lost 3 log books of mine and North Wales Police have lost my drivers Licence (Oh, that was a good one- 63MPH in a 60 at 7:32 on a Saturday morning, on an empty dual carrigeway. My Mercedes V- class 6 seater was also down as a HGV which got me 9 points and £380 fine until it went back to court again- twice!) That one took 9 months to sort out, 2 trips to Wales (400mile round trip twice) and I still have not got the fee for getting my licence back from North Wales Police.

The joy of motoring eh?

Having today received the V5C for the Popemobile and the sorn acceptance for the Vecky and re reading all this thread has made me think... where are the letters I should have received about the scrapping of the Chavalier, the Black Nissan estate, the silver Nissan and Claire's Micra.

I guess now is a good time to announce...

I have a court appearance in 2 weeks for a speeding offence I know nothing about. I have received 6 points and a £560 fine for not disclosing details of driver of an offence allegedly comitted last year. The lady I spoke to after receiving the letters could not tell me where the offence was but it was in the Chavalier... somewhere.
My appearance in court is to apply to have the case re opened so I can say it was me... if it was?... and take the one day course to avoid the points.. and the rather hefty fine

Lady PP too has received a rather nasty summons for keeping an un licenced vehicle.... which goes back to last December.
It states that papers were sent out following a sticker from some over enthusiastic copper reporting it being on public roads when it was actually on private land. She received nothing and the comment about the documentation being returned to the sender is a joke as the summons came in a non recorded brown envelope.
The above was received in response to a letter from me relating to another sticker received a few weeks back... again on private land.
On reading all the paperwork there are several indescretions over dates so it should be an interesting outing to our local Magistrates...

Our postman is cool as... so I dont know where the failure is...
